You (‘the Customer’) agree that access to and use of http://www.pennyleigh.com.au (‘the Website’) are subject to the following Terms and Conditions (‘the Terms’) together with the Privacy Policy, Refund Policy, Terms and Conditions of purchase (where applicable) and other customer service policies on the Website. By entering the Website you agree to be bound by these Terms and Policies. By continuing to use the Website you are agreeing to the Terms contained in the website. If you do not agree with the Terms you must cease usage of the Website immediately. The Website is hosted on Shopify. They provide us with the online e-commerce platform that allows us to sell our products to you.

Penny Leigh & Co reserves the right to review and change any of the Terms by updating this page at its sole discretion. When Penny Leigh & Co updates the Terms, it will use reasonable endeavours to provide you with notice of updates to the Terms. Any changes to the Terms take immediate effect from the date of their publication.

Your use of the Website is governed in all respects by the laws of the State of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts of Queensland in relation to any legal proceeding directly or indirectly arising out or relating to this site (including but not limited to the purchase of our products).

We do not control Linked Websites and are therefore not responsible for the content of any Linked Website or any hyperlink contained in a Linked Website. From time to time, Penny Leigh & Co may partner with other agencies and websites to provide promotions and giveaways. Information gathered during these promotions will not be shared with any third parties and only used by Penny Leigh & Co Participation in these events is acceptance of the Terms and our Privacy Policy.

You must provide complete and accurate details at the time of making your purchase. You may be required to provide additional details upon our request to ensure the accuracy and verification of your order. You must enter the correct shipping address and shipping instructions at the time of placing your order. If you enter an incorrect address, Penny Leigh & Co is not obliged to re-send the order to the correct address at our own expense.

Prices displayed on the Website are in Australian Dollars (AUD) and include GST.

Payment for goods from the Website is made either via PayPal or Afterpay. All goods remain the property of Penny Leigh & Co until paid for in full.

We make every effort to ensure prices and product information are listed on the Website correctly in the first instance, however, if by human or technical error, something has been listed incorrectly, Penny Leigh & Co reserves the right to amend prices. Penny Leigh & Co also reserves the right to refuse or cancel any orders placed for products listed at the incorrect price. We will endeavour to contact you and inform you if this has occurred.

Penny Leigh & Co have made every effort to display as accurately as possible on the Website the colours and images of our products that we carry in store. We cannot guarantee that your computer monitor’s display of any colour will be accurate. All weights and dimensions given are approximate. We do not warrant that the quality of any products or information purchased or obtained by you will meet your expectations.

International deliveries will be made Australia Post. Estimated delivery time for international orders varies depending on location. In the event the Customer does not receive their Order within 15 business days of placement, the Customer should contact Penny Leigh & Co.

International delivery costs do not include any taxes or duties which may be applied by customs at the destination country. Any duties or taxes incurred are the responsibility of the delivery recipient. Penny Leigh & Co has no control over the import fee charged and will not be responsible for the payment of any duties or taxes.

In accordance with Australian export regulations, customs require Penny Leigh & Co to declare the exact value of the Order on the satchel, and it is the sole discretion of the custom agents to release the package.

Where taxes and duties are refused to be paid by a Customer or where a parcel is left unclaimed and a parcel is subsequently returned to Penny Leigh & Co, the order amount will not be refunded to the customer. Refunds will not be issued under any circumstances for unclaimed or refused duties returns.

We do not accept responsibility for lost orders as a result of a third party’s negligence or otherwise, so far as we can provide proof of shipment. If your order is missing, please email sales@pennyleigh.com.au immediately.

Any return of products to Penny Leigh & Co by you will be governed in accordance with our Returns Policy

As our orders are processed and dispatched quickly (usually within hours), Penny Leigh & Co are unable to cancel or change any details in your order once it has been received by us. If you have any problems with your order, please contact Penny Leigh & Co via email as soon as possible. If the order has been dispatched, the Customer is liable for all costs associated with shipment of the order and shipment of the return of order. Please be advised that you have the option to return your order within 14 days of receipt.
